Powers Electric Guitars Limited Warranty – USA and Canada

Taylor-Listug Inc., dba Powers Electric, 1980 Gillespie Way, El Cajon, CA 92020 ("POWERS ELECTRIC"), grants the following limited warranty ("Limited Warranty") for guitars of the brand "Powers Electric", subject to the limitations set forth herein, in each case provided that (i) you are the original purchaser of the guitar, (ii) you are resident in a country of the United States or Canada, and (iii) you have purchased the guitar from POWERS ELECTRIC or an authorized POWERS ELECTRIC dealer.

1-Year Limited Warranty. POWERS ELECTRIC warrants solely to the original purchaser of this POWERS ELECTRIC guitar that the guitar purchased shall be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of original purchase. POWERS ELECTRIC further warrants solely to the original purchaser that all POWERS ELECTRIC pickups and pickup systems – including installed guitar pickups and pickup systems sold separately – shall be free from defects in workmanship and materials for a period of one (1) year from the date of original purchase.

Extended Warranty with Registration.  If the original purchaser of this POWERS ELECTRIC guitar properly registers the guitar within ninety (90) days from the date of original purchase, the 1-Year Limited Warranty period shall be automatically extended (except, however, in respect of any electronic components) for an addition four (4) years, for a total of five (5) years of Limited Warranty coverage.  If the guitar is not properly registered by the original purchaser within ninety (90) days of original purchase, it shall remain subject to the 1-Year Limited Warranty period.  To properly register the guitar, go to: [hyperlink].

Warranty Repair. If you make a valid claim under this Limited Warranty, POWERS ELECTRIC will, at its choice, either repair the defective product or replace its defective parts without charge to you for either parts or labor.  For such repair or replacement ("Warranty Repair"), POWERS ELECTRIC may utilize the materials and parts then in use rather than the original materials and parts used for production of the product. POWERS ELECTRIC may choose to have the Warranty Repair carried out on its behalf by an authorized POWERS ELECTRIC dealer, distributor or repair center.

Exclusions.  This Limited Warranty does not apply:

(a) to wear and tear of the guitar, including but not limited to normal wear and tear or breakage of frets, strings, nuts, saddle, batteries, or other damage or deterioration due to normal wear and tear, or to normal wear and tear or breakage of any part of the guitar, including but not limited to controls, switches, jacks, plated surfaces, tuning devices, pickguards or finish, or to any instrument case or gig bag, including gig bag handles, zippers, latches, case hardware, or finish;

(b) to asserted defects or damage that are part of normal usage or that are caused by modification, misuse, neglect, abuse, accidents, acts of nature, or improper maintenance or storage of the guitar or its parts (POWERS ELECTRIC reserves the exclusive right to make such determination of misuse, modification, or neglect based on inspection by POWERS ELECTRIC);

(c) to asserted defects involving subjective personal likes or judgments, including subjective opinions regarding tonal characteristics of the guitar or grain characteristics or colors of woods;

(d) to asserted defects or damage to a guitar such as cracks, splitting, or warping of wood or damage to the guitar’s finish caused by accident or exposure to changes in or extreme instances of temperature or humidity, exposure to sunlight, moisture, body salts or acids, guitar straps, or guitar stands or hangers which cause harm to the guitar;

(e) to defects asserted by any purchaser who did not purchase the guitar from an authorized POWERS ELECTRIC dealer in the United States of America or Canada;

(f) to guitars owned by non-U.S. or non-Canadian residents;

(g) to electrical components not manufactured by POWERS ELECTRIC;

(h) to setups, adjustments, or any routine maintenance;

(i) to any guitar whose serial number is missing, altered, or tampered with in any fashion; or

(j) to asserted defects or damage to a guitar which has had work performed on it by or has been otherwise repaired or modified by a technician or repair person other than a POWERS ELECTRIC certified technician at an authorized POWERS ELECTRIC service center.

Limitations. THE OBLIGATIONS OF POWERS ELECTRIC HEREUNDER ARE LIMITED TO REPAIR OR REPLACEMENT OF PARTS OF THE GUITAR FOUND TO BE DEFECTIVE UNDER THIS LIMITED WARRANTY. IN NO EVENT SHALL POWERS ELECTRIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO TIME, WAGES OR LOST PROFITS, OF ANY NATURE OR KIND OR FOR DAMAGES TO OR LOSS OF PROPERTY.

This Limited Warranty does not cover circumstances beyond POWERS ELECTRIC’s control nor does it apply when failure is due to shipping damage, accident, alteration, modification, unauthorized service, misuse, abuse, use with incompatible accessories or attachments.  THIS LIMITED WARRANTY IS THE SOLE WARRANTY OF POWERS ELECTRIC WITH REGARD TO GUITARS ONLY AND IS GIVEN IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PURPOSE.

In addition, POWERS ELECTRIC reserves the right to modify, refine, or improve its instruments, parts and pickup systems, including making mechanical and electrical refinements and wood species substitutions, without incurring any responsibility to modify, exchange, replace or repair any parts or products to meet prior specifications. 

Specific rights might vary by state or in Canada, so the above limitations or exclusions may not apply to you.

No Other Warranties. The Limited Warranty set forth herein constitutes the entire warranty and representation of POWERS ELECTRIC with regard to the POWERS ELECTRIC guitars. This Limited Warranty shall be controlling over any conflicting terms and conditions of any purchase orders, contracts or invoices which may be executed in connection with the purchase of any POWERS ELECTRIC guitar. NO representation or warranty made by any POWERS ELECTRIC salesperson, dealer, agent, representative or employee shall be binding upon POWERS ELECTRIC other than as set forth herein.

Claim Procedures. In order to make a claim under this Limited Warranty, you must first contact POWERS ELECTRIC. Unless the original purchaser is notified in writing that repairs and service may be made by an authorized POWERS ELECTRIC dealer or authorized POWERS ELECTRIC warranty repair center, claims for Warranty Repair shall be made by the original purchaser sending the guitar to POWERS ELECTRIC. You must first call POWERS ELECTRIC to obtain a return authorization number and then send the guitar to POWERS ELECTRIC at 1900 Gillespie Way, El Cajon, CA, 92020, to the Attention of the Repair Department, listing the RA (return authorization) number on the outside of the box. Shipping and insurance must be prepaid by the original purchaser. The original purchaser also must include any permits required for export of the guitar from original purchaser’s country (if located in Canada), prepaid by original purchaser, together with: (a) evidence confirming the original purchase by purchaser (such as a copy of the sales invoice or receipt, a credit card slip, or the like); (b) a brief description of the nature of the asserted defect and photographic or other documentary evidence requested by POWERS ELECTRIC; and (c) the name, address and phone number of the original purchaser to whom the guitar is to be returned. Please call Customer Service prior to shipping your guitar. If you fail to contact POWERS ELECTRIC prior to exporting your guitar from Canada, or if you fail to get any necessary permit for your guitar, the guitar could be subject to government confiscation and/or POWERS ELECTIRC may not be able to obtain a permit to ship it back to you in Canada. POWERS ELECTRIC shall review the description of the asserted defect, examine the guitar, and make Warranty Repair as valid and appropriate under this Limited Warranty. Upon completion of the Warranty Repair, the guitar shall be returned by POWERS ELECTRIC to the original purchaser, with shipping, permits and insurance to be paid by the original purchaser. In the event it is determined that the asserted defect is not covered by or is excluded from this Limited Warranty, the guitar shall be returned to the original purchaser, without repairs or replacement, with shipping, permits and insurance to be paid by the original purchaser.

Non-transferability.  This Limited Warranty is not transferable or assignable in whole or in part without POWERS ELECTRIC’s prior written consent.

Legal Remedies. Depending upon the state in which you reside, you may have additional legal remedies available under the applicable commercial code or consumer warranty laws.
